  4.       Software written and distributed by James R. Davis will hereby be
  5. known as DavisWARE.  Any references therein this document to DavisWARE
  6. will mean any software that has been written by James R. Davis and the
  7. copyright notification within the program itself.  For the latest updates
  8. and full technical support call the Programmer's Mega-Source BBS at
  9. (516) 737-4637.  You may also place your order directly on this BBS for
  10. faster response!

  12.       DavisWARE is Copyrighted by James R. Davis as of October 1992 and
  13. is covered by US and International Copyright laws.  The author reserves
  14. all rights.

  16. Liscense:
  17.  
  18.    You are granted a limited liscense to use DavisWARE for a thirty (30)
  19. day period for the purpose of evaluating it for your own use.  After
  20. thirty days, you are required to either register DavisWARE or stop using
  21. it. To continue using it is a violation of copyright laws and just not a
  22. nice thing to do..

  24.    The Shareware version of DavisWARE is NOT crippled in any way.  There
  25. are no missing features or timers.  The only differences between the
  26. registered and unregistered versions of DavisWARE are, the Shareware
  27. version places the word "UNREGISTERED" in the bulletin and displays the
  28. UNREGISTERED logo on the computer screen as part of the copyright
  29. notice, or within some programs a small feature may not be available.
  30.  
  31. BBS Distribution:
  32.  
  33.    BBSs are granted a limited liscense to distribute DavisWARE in a
  34. compressed format.  The distributing BBS is not limited to the type of
  35. compression method used for distribution.  However, the BBS must follow
  36. the following guidelines:
  37.  
  38. 1. If DavisWARE is distributed in a ".ZIP" file, the BBS must do it's
  39.    best to preserve the "AV" that DavisWARE was compressed with by the
  40.    author.  If a BBS wishes to have DavisWARE sent to them directly
  41.    from the author, please contact the author and a copy will be sent
  42.    either by US Mail, or uploaded directly to the BBS.  The sole
  43.    exception to distribution of DavisWARE without the security "AV"
  44.    placed by the author is where a BBS uses a program to validate their
  45.    uploads that, as a part of validation, reZIP's the file for maximum
  46.    compression (not necessary since the distribution archive from the
  47.    author is created with maximum compression enabled).

  49. 2. No BBS may, in re-ZIPing DavisWARE, add to the ".ZIP" their own "AV"
  50.    which does not belong to the author.
  51.  
  52. 3. No BBS is authorized to add any files to the archive which are not
  53.    part of the original DavisWARE archive as distributed by the author.
  54.    The sole exception is where a BBS adds an ASCII text file (containing
  55.    no ANSI codes of any type) as an advertisement, and the filename for
  56.    the file has not and/or will not change, and the BBS does not "cycle"
  57.    filenames for the purpose of "fooling" upload checking programs from
  58.    other BBSs which remove such advertisements.

  60. 4. No user may be charged any additional fee just to download DavisWARE
  61.    from the BBS.

  63. Shareware Vendor Distribution:
  64.  
  65.    This copyrighted software and its documentation is NOT PUBLIC DOMAIN.
  66. However, DavisWARE may be distributed at no charge, or for a charge not to
  67. exceed $12 US to cover shipping and media costs.  When secondarily
  68. distributed, DavisWARE must be in its original compressed form and
  69. accompanied by its full documentation.  The distributed software and
  70. documentation may not have been modified in any way.

  73.    No secondary distributor is authorized to "register" an individual
  74. copy of DavisWARE.  Registration fees may only be sent directly to the
  75. author as outlined in the manual on disk.  Note that the registration fee
  76. is exclusive of, and over and above any fees that may have been charged by
  77. a secondary distributor.

  79.    A secondary distributor must notify it's customers that DavisWARE are
  80. shareware programs and that the fee payed by their customer does not
  81. include any fees owed the author for use of this program.
  82.  
  83.    A secondary distributor must notify the author of their intention to
  84. include this group of files in their distribution.  A secondary distributor
  85. may be granted exceptions to these conditions, only in writing from the
  86. original author.

  88.    The author reserves the right to change any of these conditions without
  89. notice and any changes become retroactive.  Failure to abide by this liscense
  90. agreement may result in either Civil Lawsuit or Criminal charges being filed.

  95.    Shipping and Handling:

  97.       All orders REQUIRE a shipping and handling charge as shown below. 
  98.       These charges cover our costs in shipping your order and tracing
  99.       delivery problems.

  106.       Once your order has been recieved and processed, you will be mailed
  107.       a letter containing your serial number and instructions for using it
  108.       in your configuration file.

  110.       Orders typically require 3 - 4 business days processing time before
  111.       shipment, and may take more or less depending on our order backlog.
  112.       US standard shipping is via UPS Ground, via US Priority Mail where
  113.       UPS delivery is impossible (PO Boxes, Alaska, Hawaii, and APO / FPO
  114.       addresses), and via First Class Mail for diskette-only orders.  US
  115.       2-day shipping is via UPS Blue Label.  All shipping outside the US is
  116.       via Air Mail.  Shipping time varies from 1 business day for UPS
  117.       Ground to New England, to 6 business days for UPS Ground to California,
  118.       to several weeks for countries outside the US where mail service
  119.       is slow.  Express shipping via UPS Red Label or Federal Express is
  120.       available; contact us for rates.

  122.    Payment Terms:

  124.       Personal checks may be subject to a bank clearance delay before
  125.       shipment.  All payments must be made in US funds and drawn on a US
  126.       bank; see below for more details on international orders.  There
  127.       is a $7 charge for all returned checks.  All personal checks must
  128.       be made out to James R. Davis, or you may not receive your order.

  130.    Credit Card Orders:

  132.       You may order any DavisWARE program with a major credit card for a
  133.       modest processing fee of 14.19% of the total price after all
  134.       adjustments have bee made.  Use the space provided below to enter your
  135.       credit card information.  We accept Visa, MasterCard, American Express,
  136.       and the Discover Card.

  138.    International Orders:

  140.       We are happy to accept orders from outside the US, but must require
  141.       payment in the correct form to avoid the exorbitant fees charged by
  142.       US and non-US banks for international check collections.

  144.       Acceptable Payment:

  146.           *  A check or money order in US funds and drawn on a US bank.
  147.              Checks which are not in US funds and drawn on a US bank must
  148.              unfortunately be returned to you, resulting in significant
  149.              delay in processing your order and additional expense to
  150.              you.
  151.           *  A major credit card.  If the card holder's name and address
  152.              differ from the person who is registering, please include the
  153.              information to expidite your order.  We currently accept Visa,
  154.              MasterCard, American Express, and the Discover card.
